1. Who we are
Infinite Global Solutions (Private) Limited is a Sri Lankan private limited company (Company No. PV 00269216) providing (a) visa consultation and related travel-support services, and (b) information-technology services, including websites, mobile applications, custom software, e-commerce platforms, UI/UX design, hosting-related work, maintenance and other digital products we may launch from time to time. These Terms apply to all of those activities unless a separate written contract says otherwise.
Where we issue a proposal, statement of work, invoice or product-specific terms for a particular engagement or product, those documents apply together with these Terms. If there is a conflict, the more specific written document prevails for that engagement or product.
2. Scope
These Terms apply to:
- our website and any related landing pages, forms and communications;
- visa consultation, documentation guidance, application support and related professional services;
- software, websites, applications, SaaS products, subscriptions, in-app features and other digital services we operate or licence;
- quotations, invoices, support and payments processed through PayHere or another payment method we nominate.
These Terms do not create a partnership, employment or agency relationship. We are not a law firm, not an embassy or immigration authority, and not a university. Visa decisions are made solely by the relevant government, embassy, university or other third party.
3. Eligibility and accounts
You must have legal capacity to contract under Sri Lankan law. Digital products and online accounts are intended for persons aged 18 years or older, unless a product page says otherwise. If you use our visa services on behalf of a minor, you must be a parent or legal guardian and you accept these Terms for yourself and for that minor.
You are responsible for the accuracy of information you give us, for keeping login credentials confidential, and for all activity under your account. Notify us promptly if you suspect unauthorised use.
4. Visa consultation services
4.1 Nature of the service
Visa consultation is professional guidance. We help you understand requirements, prepare documents and submit or track applications where agreed. We do not guarantee that any visa, admission, permit, ticket or appointment will be granted, issued on time, or issued on any particular terms. Approval rests with the relevant authority.
4.2 Your duties
You must:
- give complete, truthful and current information and documents;
- tell us immediately about any change that may affect an application (travel history, refusals, finances, health, marital status, employment);
- meet deadlines we or the relevant authority set;
- pay official fees (embassy, university, medical, insurance, courier, tickets) in addition to our service fee, unless an invoice expressly includes them.
4.3 Third-party fees and decisions
Embassy, university, medical, insurance, examination, courier and airline charges are set by those third parties. Once we have paid or submitted such a fee on your instruction, it is generally outside our control. A refusal, delay or request for more documents by an authority is not a breach of these Terms by us.
5. Software, websites, applications and digital products
We design, build, host, maintain or operate software and digital products for clients, and we may also offer our own products (including mobile applications and paid features). Unless a separate licence says otherwise:
- we grant you a limited, non-exclusive, non-transferable right to use the product for its intended purpose;
- we retain all intellectual property in our code, designs, branding, documentation and content;
- you retain intellectual property in content you lawfully upload, and you grant us a licence to host and process it as needed to provide the service;
- we may update, suspend or discontinue a feature with reasonable notice where practicable;
- we do not warrant that software will be error-free, uninterrupted, or compatible with every device.
If a product has its own in-app terms, community rules or subscription terms, those apply in addition to these Terms. Paid digital access is to features, not to a promised personal or business outcome.
6. Client project work
Custom websites, apps and software are delivered against a written scope, timeline and fee. Changes to scope may change the fee and the date. You must provide content, access, feedback and approvals in a timely way. Delay on your side extends our timeline. Unless agreed in writing, source code, design files and licences transfer only after full payment.
Third-party tools (domains, hosting, app-store accounts, plugins, stock assets, SMS or payment gateways) remain subject to those vendors’ terms and fees.
7. Fees, invoices and payments
Prices are shown in Sri Lankan Rupees unless we state another currency. Taxes that apply at the time of purchase are included or identified at checkout or on the invoice. Online payments may be processed by PayHere (PayHere (Pvt) Ltd) or another gateway we name. Card details are entered on the gateway’s pages, not on our servers.
Invoices are due as stated on the invoice. We may pause work or access if a payment is overdue. Recurring subscriptions renew automatically until cancelled in accordance with the Refund & Cancellation Policy. Bank, wallet or foreign-exchange charges levied by your own provider are yours.
8. Acceptable use
You must not, and must not allow others to:
- use our services for any unlawful purpose, fraud, money-laundering or sanctions evasion;
- submit false, forged or misleading documents or identity information;
- harass, impersonate, exploit or harm other users;
- upload malware, scrape our systems without permission, or attempt to gain unauthorised access;
- infringe intellectual property or privacy rights;
- resell our services or create a competing product using our confidential materials;
- use a digital product in a way that violates its published community or usage rules.
We may suspend or terminate access, refuse an application, or withhold deliverables if we reasonably believe these rules have been broken.
9. User content
You are solely responsible for documents, photographs, profile information and other content you supply. You confirm you have the right to provide that content and that it is accurate. We may remove content that is unlawful, misleading, or in breach of these Terms. We are not obliged to monitor all user content but may do so to operate, secure or improve the service or to meet the law.
10. Confidentiality
Each party must keep the other’s non-public business, technical and personal information confidential and use it only to perform the relevant service, except where disclosure is required by law, a regulator, a court, or a visa or educational authority you have asked us to deal with.
11. Privacy
We handle personal data as described in our Privacy Policy and the Personal Data Protection Act, No. 9 of 2022. Visa work and software products may require sharing data with third parties (for example payment processors, hosting providers, universities or immigration authorities). Please read the Privacy Policy before you submit personal data.
12. Disclaimers
Services are provided with reasonable skill and care. Except for duties we cannot exclude by law:
- we do not guarantee visa, admission or commercial outcomes;
- we do not guarantee uninterrupted or error-free software;
- information on the website is general and may change;
- third-party sites, stores, banks and authorities are outside our control.
13. Limitation of liability
To the maximum extent permitted by Sri Lankan law, we are not liable for indirect, incidental, special or consequential loss, loss of profit, loss of data, or loss of opportunity. Our total aggregate liability arising out of a service or product is limited to the fees you paid us for that service or product in the three (3) months before the claim. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be limited under the Consumer Affairs Authority Act, No. 9 of 2003 or other mandatory law.
14. Indemnity
You will indemnify us against claims, losses and reasonable costs arising from your breach of these Terms, your content, or your misuse of a service, except to the extent caused by our own negligence or wilful default.
15. Suspension and termination
You may stop using a service at any time, subject to the Refund & Cancellation Policy and any minimum term in a written contract. We may suspend or end a service if you breach these Terms, if required by law or a payment partner, or if we discontinue a product (in which case unused prepaid fees are handled under the Refund & Cancellation Policy).
16. Force majeure
We are not responsible for delay or failure caused by events beyond reasonable control, including failure of utilities, networks, app stores, banks, payment gateways, government action, epidemic, or acts of a visa or educational authority.
17. Changes
We may update these Terms. The current version will be published on our website. Material changes will be notified on the website or by e-mail where we have your address, at least fourteen (14) days in advance where practicable. Continued use after that date is acceptance of the new Terms. The version in force when you paid for a service governs that purchase.
18. Governing law and disputes
These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. They are an electronic record under the Electronic Transactions Act, No. 19 of 2006. Please contact us first so we can try to resolve a complaint. If we cannot, the courts of Colombo, Sri Lanka have jurisdiction.
